A.    Use of the Site

The website www.dms-cg.com, or any of its subdomains (the “Site”) is the property of Digital Media Services FZ-LLC, an affiliate of the Choueiri Group, (and together with its affiliates hereinafter referred to as “DMS”, “we”, “us”).

The access to and use of the Site is subject to the following terms and conditions (the “Terms”).

By using the Site or any of its sub-domains, you agree to be legally bound by these Terms, which shall take effect immediately on your first use of the Site. If you do not agree to these Terms of use, please do not use the Site.

We reserve the right, at our discretion, to change, modify, add, or remove portions of these Terms at any time without the need to notify you. Please check these Terms periodically for changes. Your continued use of this Site following the posting of changes to these Terms will mean you accept those changes.

Your access to the Site may be terminated immediately without notice from us if in our sole discretion you fail to comply with any term or provision of these Terms. Upon termination, you must cease use of the Site and destroy all materials obtained from such site and all copies thereof, whether made under these Terms or otherwise.

Any unlawful use of the Site can result in legal action.

B.    Access to the Site

Access to the Site is for non-commercial use only. You may download one  copy of the materials on any single computer for your personal, non-commercial  use only, provided that:

  1. you keep intact all copyright and other proprietary notices;
  2. you make no modifications to the materials;
  3. you do not use the materials in a manner that suggests an association with DMS or any of our products, services, or brands;
  4. you do not download quantities of materials to a database that can be used to avoid future downloads from this Site. For purposes of these Terms, the use of any such material on any other website or computer environment is prohibited.
  5. You agree not to alter, or create a derivative work from the Site content.

C.    Site Content and Copyright

The Site contains copyrighted material, trademarks and other proprietary information, including, but not limited to, text, photos, video, graphics, music, sound and software.

The entire content of the Site are copyrighted under the UAE copyright law (Federal Law no. 7/2002). You may not modify, publish, translate, transmit, participate in the transfer or sale, create derivative works, or in any way exploit, any of this Site’s content, in whole or in part.

Where made available for download by DMS, you may download copyrighted material for your personal use only. Except as otherwise expressly permitted under UAE copyright law, no copying, redistribution, retransmission, publication or commercial exploitation of downloaded material will be permitted without our express permission and/or the copyright owner. In the event of any permitted copying, redistribution or publication of copyrighted material, no changes in or deletion of author attribution, trademark legend or copyright notice shall be made.

D.    Disclaimers and Limitation of Liability

The Site’s content, including the information, names, images, pictures, logos and icons regarding or relating to DMS, its products and services (or to third party products and services), is provided "as is" and on an "is available" basis without any representations or any kind of warranty made (whether express or implied by law), including the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.

We cannot ensure that you will be satisfied with any content on our sites. We have not taken any steps to confirm the accuracy or reliability of, any of the information contained in our sites.

Under no circumstances, including, but not limited to, negligence, shall we be liable for any direct, indirect, incidental, special, or consequential damages that result from the use of, or the inability to use, the site or materials or functions on our site, even if we have been advised of the possibility of such damages.

These Terms shall be governed by and construed in accordance with the laws of the Emirate of Dubai and the Federal Laws of the United Arab Emirates as applied in Dubai.

DMS is committed to protecting your personal information. This privacy policy details how the Site collects, uses and shares the information we or our third-party vendors, collect from you online.

This privacy policy applies to anyone who uses the Site or any services we make available online (hereinafter referred as “DMS Online Services”).

Please, carefully review this Privacy Policy and more generally our Terms of Use.  By browsing or using the Site, you expressly agree to be bound by the Terms and Conditions and the Privacy Policy, and you consent to our collection, usage and sharing of your personal information, as well as any additional information discussed within this Privacy Policy.

     I.         Personal data

a)    Personal information you provide to us and we collect

When you use DMS Online Services we may receive or collect and we may retain personal information about you.

In particular, when you sign up to any DMS Online Services (such as electing to receive the DMS newsletter service or downloading any materials made available by DMS on the Site), you provide personally identifiable information such as your email address, your name, your age, and your nationality. Or, you may provide your e-mail address to participate in our interactive programmes, or your location to benefit from a customized newsletter adopted to the region where you reside.

In addition, we collect, by default, standard data such as your IP address or additional data like anonymous labels, through labels and information provided by OS in order to understand how DMS Online Services are being used or to benefit from push notification.

Individuals under 16. DMS does not intentionally, or knowingly, process personal information from individuals under the age of 16. When necessary, users under the age of 16 will be told not to submit any personal details. We will make every effort to delete any details of such users where a parent or guardian has informed us that these details have been collected.

  1. How we use your personal information

Our main objective is to collect and use only the information we believe is necessary for the performance of DMS’s Site and the provision of DMS Online Services where available, in order to better understand your interests and improve your experience of using our Site.

We use your data (including personal information) notably to:

  • manage your access to DMS Online Services where applicable and when you have requested us to do so;
  • to manage your privacy preferences and to ensure you only receive communications that you have requested, which may include your details to suppress you from communications;
  • to send you administrative emails about your subscriptions to DMS Online Services (such as our newsletter service), services changes or new policies.
  • improve user experience on our Site;
  • enable operation of our analysis tool(s) that enables us to measure and analyze information with regard to your use of our Site; to learn more about these platforms and other third-party suppliers of technology, please consult our Cookie Policy below.
  1. The measures to protect your information

We will securely store your information confidential except when disclosure is required by law or for technical purposes. Indeed, your personal information may be transmitted to suppliers of technology and services to ensure the optimum operation of the Site and DMS Online Services. When this is the case, we will ensure your personal information is treated with a similar, but no less stringent, level of care as the one we apply.

We securely store your information for as long it appears necessary to ensure effective operation of our DMS Online Services in accordance with applicable law. If you have not interacted with us in any way, we will generally no longer hold your information after 5 years. We would only keep it for longer than this if we are required by law or if we have a regulatory reason to justify such longer retention.

DMS only processes your personal data for the purposes described in these Terms; it does not divulge them for other purposes.

If you request for us to no longer contact you, for example with marketing communications, we will retain the minimum amount of information about you so that we can ensure we remove you from any future communications. Please note that if you ask us to completely remove all information about you, and you subsequently use our products and services at a later date, we will no longer be able to recognise your previous request to not be contacted, which is why we would keep it and suppress it in line with industry standards.

d)    Storing and transferring information internationally

As the internet is a global environment and we work with third parties across the globe, collecting and using your personal information may involve the transfer of this information internationally, including outside of the European Union. By using our products and services you acknowledge and agree to your personal information being transferred in this way, including to jurisdictions outside the EEA.

We maintain strict policies to ensure all information that is transferred is done so safely and securely.

e)    Legal framework: right of access, modification, suppression and deletion

The applicable legal framework is the European and United Arab Emirates framework irrespective of the country you reside in.

In the European Union, the processing of personal data is governed by the General Data Protection Regulation (EU) No 2016/679.

For the Emirate of Dubai, the Dubai Ruler’s Decision no. 2/2017 and for the United Arab Emirates, the relevant laws and regulations of the United Arab Emirates, as applicable by the Emirate of Dubai.

You can exercise your right of access, request to modify, suppress or delete data related to you. However, please note that there are circumstances in which complete erasure of your information or ceasing to process your information will not be possible for operational, legal and business reasons. This may include if you remain a customer for whom we need to provide services, or if you wish us to no longer contact you for marketing purposes. In this case we may need to retain some of your details securely in order to facilitate this request by, for example, keeping you on a “do not contact” or suppression list.
